This form can be used to create a simple lease document. You should consult an attorney to make sure it complies with all of your state and local housing regulations and perhaps to add additional terms for early termination and default.
This AGREEMENT is made on the <Day> day of <Month>, <Year> between <Name of Lessor>, <of> <Full Address of Lessor> ("Lessor") and <Name of Lessee>, <of> <Full Address of Lessee> ("Lessee").
For and in consideration of the payment of the rents and the performance of the covenants contained on the part of the Lessee, Lessor does hereby demise and let unto the Lessee, and Lessee hires from Lessor for use as <intended use> those certain premises described as <property description> located at <property address> for a tenancy commencing on <Start Date> to <End Date>, at the rental rate of <Rent amount> per <period>.
The parties stipulate and agree further that:
Lessee shall quit and surrender said premises in the event of default on payment of rent or in any event upon termination of this Agreement. Notice of desire to terminate this Agreement before the date stated above must be received by Lessor not less than 20 days before the desired end date, receipt of which in no way obligates Lessor to release Lessee from the obligations herein.
Lessee shall not violate any city ordinance or state law in or about the premises and shall maintain said premises in a clean and sanitary condition.
Lessee shall not sub-let the demised premises, or any part thereof, or assign this agreement without the written consent of the Lessor.
Lessee, in case of fire or theft, shall give immediate notice thereof to the Lessor or designated agent of same.
Lessee must not make any alterations or improvements to said premises, without written consent of Lessor.
Lessee agrees to allow Lessor access to said premises for the purposes of inspection; making alterations, improvements or repair; and exhibiting the premises to potential purchasers, tenants or workmen. Except in the case of emergency, such access shall be at reasonable time and after reasonable attempt to give notice.
If legal action takes place or must be instituted by Lessor, Lessee agrees to pay all reasonable costs, expenses and to pay all reasonable attorney's fees, as the court may affix.
A non-refundable deposit has been made and Lessor hereby acknowledges receipt of $<amount> covering <deposit distribution>.
Additionally, a cleaning deposit has been made and Lessor hereby acknowledges receipt of $<amount>. This deposit will be refunded if premises are left in clean condition. If cleaning expenses must be incurred by Lessor to restore the premises to the condition they were in at the time of Lessee's occupancy, the amount necessary for said restoration will be deducted from the cleaning deposit and the balance, if any, will be refunded to Lessee. The amount of said cleaning deposit in no way limits Lessee's liability for damage to the premises.
